This Week in Annapolis

  This will be a busy week for ABC in Annapolis as we anticipate testifying on bills dealing with safety, apprenticeship, right to work and corporate income tax reductions.  Below, please find links to the referenced bills.

Construction Codes Harmonization Amendment Act of 2015

  On Monday, February 9th Chairman Mendelson at the request of the Mayor introduced Bill 21-69 the "Construction Codes Harmonization Amendment Act of 2015". The legislation as introduced would amend the District's construction laws to provide for the installation of fire escapes and carbon monoxide detectors, and authorizes the Mayor to adopt fire safety standards and impose various fees or tax liens to to regain funds disbursed while repairing unsafe structures that are not owned by the District. Whats Your Opinion?: PURPLE LINE

  The proposed light rail purple line is currently being reviewed by Hogan Administration.  The line would provide service between Bethesda and New Carrollton with 21 planned stations.  Both Montgomery and Prince George’s County governments are supporting the construction of this project.  It is currently being proposed as a P3 (public-private partnership) project.  The current construction cost is $2.3 billion.


"Notice of Second Proposed Rulemaking" for the Title 13 DCMR, Sign Regulations

  On Friday, February 13th the Office of the Mayor issued the "Notice of Second Proposed Rulemaking" for the Title 13 DCMR, Sign Regulations.  Under the new proposed regulations, there are changes to the Temproary Construction Signs which are outlined in section 721. In addition there are also changes to the signs used on construction projects in section 806 and changes to the structural and technical requirements for signage which can be found in section 1200 of the proposed regulation.  The comment period for the proposed rules is open for the next 45 days.  At that time the Mayor will close the comment period and publish the final rulemaking.  The final rules will go into effect 90 days after the publishing of the offical rules.  ABC of Metro Washington will submit comments on behalf of the membership on March 31st. Contact Eric J. Apprenticeship Legislation Introduced

  Delegate Cory McCray from Baltimore City has introduced legislation which would require employers to pay the full cost of tuition for apprentices working on state prevailing wage projects.  The ABC Joint Legislative Committee met with the Delegate to discuss this proposal and will be making a recommendation at its February 16 meeting.  If you have any comments or recommendations, please contact Bob Zinsmeister at 301-595-9711. Joint Public Hearing on the Marijuana Legalization and Regulation Act of 2015 & the Prohibition of Pre-Employment Marijuana Testing Act of 2015

  Monday, February 9, 2015 the DC City Council held a joint public hearing on Bill 21-023 the Marijuana Legalization and Regulation Act of 2015 and Bill 21-025 the Prohibition of Pre-Employment Marijuana Testing Act of 2015.  After hearing the testimony of ABC of Metro Washington Vincent B. Orange, Sr Chair of the Committee on Business, Consumer and Regulatory Affairs agreed to amend Bill 21-025 to allow companies to test potential employees for marijuana after a tentative offer has been made.

DC City Council Passes Emergency Legislation Amending the Wage Theft Prevention Act

  On Tuesday, February 3, 2015 the DC City Council passed emergency legislation to amend the Wage Theft Prevention Act.  Under the amendments which passed 11-0 the companies will only be required to provide notification to their employees of changes in pay in the languages mandated under the DC Language Access Act. In addition the legislation also removed the requirement for non hourly employees to file detailed time sheets and from being paid every 14 days (26 times a year).

Montgomery Councilmember Wants Health Insurance Preference

  County Councilwoman Nancy Navarro has introduced legislation which would give a preference in the competitive procurement of services by the County for a business that provides health insurance for its employees.  The bill does not specify what the preference would be as it would be incumbent upon the County Executive to adopt a regulation implementing the preference.  If you have any comments or would like a copy of the bill, contact Bob Zinsmeister at 301-595-9711.

Joint Public Hearing on Bill 21-023 on February 9

  On Monday, February 9, 2015 the DC City Council's Committee on Business, Consumer, and Regulatory affairs along with the Committee on Finance and Revenue and the Committee on the Judiciary will hold a joint public hearing on Bill 21-023 the Marijuana Legalization and Regulation Act of 2015 and Bill 21-025 the Prohibition of Pre-Employment Marijuana Testing Act of 2015.  The legislation if passed would legalize the possession, consumption, display, purchasing, or transporting of marijuana and marijuana-infused products for personal use, not in public, for persons over the age of 21.  In addition the legislation would amend Title 18 of the D.C. Municipal Regulations to adjust allowances of THC concentration while operating a motor vehicle and prohibit employers from testing potential employees for marijuana use during the hiring process, unless otherwise required by law.  For more information on the legislation or to offer comments for the chapter's testimony,  contact Eric Jones at (202) 34 ...

Mark your calendars for our Legislative Reception on 2/25

  Mark your calendars.  The four Maryland ABC Chapters will be hosting a Legislative Reception on Wednesday, Feb. 25. ALL members of the General Assembly are being invited along with Governor Hogan, Lt. Governor Rutherford and key Department officials and Administration staff.  You won’t want to miss this opportunity to interact with the key members of the General Assembly along with our new leadership at the Executive level. There are already several issues facing the General Assembly of interest to ABC members including dealing with the proposed budget submitted by Governor Hogan and its impact on capital spending for 2015 and beyond.  The mandated sick and safe leave bill has already been introduced and is expected to bring about a great deal of debate and discussion as it comes with a large price tag if implemented as proposed.
